AARTO: The Missing Piece in South Africa’s Road Safety Puzzle

South Africa has a high rate of road accidents and deaths. Speeding, reckless driving, drunk driving and unroadworthy vehicles are major causes. That is why the AARTO Act matters: it aims to make roads safer nationwide.

AARTO sets up one system to enforce road traffic laws. Drivers and vehicle owners are jointly liable. Both answer for unroadworthy vehicles and driver behaviour. As a result, companies can no longer hide behind their drivers.

By implementing AARTO on a countrywide basis, AARTO will:

  • Reduce accidents and fatalities: Improve road safety and save lives.
  • Hold companies accountable: Ensure that companies are responsible for the condition of their vehicles.
  • HOLD COMPANIES RESPONSIBLE & ACCOUNTABLE for driver behaviour whilst using company vehicles.
  • ensure companies only appoint capable Proxies & Representatives.
  • Promote roadworthiness: Encourage better vehicle maintenance and reduce the number of unroadworthy vehicles on the roads.
  • Create a fairer system: Establish a more equitable approach to road traffic enforcement (Owner and Employee will incur penalties).

AARTO is a critical step towards creating safer roads for all South Africans. It is a necessary tool to address the longstanding issue of unroadworthy vehicles, Driver Behaviour, and non-compliant companies. In this way, the system promotes a culture of road safety.

In short, the longer you wait, the more you pay.

Each violation brings a fine and demerit points. Accumulating too many Demerit Points can result in a suspension of your driver’s license and or the vehicle licence.

The law holds both drivers and operators accountable for traffic violations. Do you operate a bus, a taxi, a vehicle over 3,500 kg or a vehicle for reward? If so, double penalties apply to you. Fines & Demerit points will be issued to both the driver and the operator.

AARTO affects every business whose staff drive for work, in company vehicles or their own. To maintain business continuity and mitigate risks, companies must:

  • Monitor employee driving behaviour
  • Amend employment terms and conditions.

An employee can have their licence blocked simply by not paying their fines, or suspended for gathering too many demerit points, whether at work or in their own time. For this reason, it is a real risk to your business continuity.

Many South African drivers simply do not pay their traffic fines. Under AARTO, unpaid fines lead to an enforcement order that blocks licence renewals. Under the Administrative Adjudication of Road Traffic Offences (AARTO) Act, these penalties can have severe implications for both individuals and businesses.

In other words, an employee’s unpaid fines can directly affect your business. If a driver loses their licence, they may not be able to do their job. That costs your business time and money.

So give all your employees proper AARTO training. Staff who understand the consequences drive more safely. That protects your business and their jobs.

Where does AARTO apply now?

Since 1 July 2026, in 62 municipalities across most provinces, plus Johannesburg and Tshwane. Western Cape municipalities are not in this phase. Drivers from outside these areas are still subject to AARTO if they commit an infringement inside an AARTO area.

When do demerit points start?

A further phase is planned for the near future. It is expected to take AARTO nationwide and switch on the demerit points system.

How long do I have to pay an AARTO fine?

32 days to qualify for the 50% discount. After that the discount falls away, a fee is added, and the process moves towards an enforcement order that blocks licence renewals.

Is a fine sent by email, SMS or WhatsApp valid?

Yes. Notices served this way are legally binding.
